Felony Child Neglect Dismissed for Lack of Probable Cause

Despite numerous orthopedic injuries to an infant and the defendant having dealt with enormous pressure from social services child protection, Alex took an extremely difficult case for a defendant and represented her in a CHIPS case (Child in Need of Protection or Services), and a Termination of Parental Rights matter.  While challenging the termination at the Minnesota Court of Appeals, Alex simultaneously prepared the criminal matter for trial, preparing to present the numerous indications that the child suffered from medical conditions predisposing the child to fracture easily.  However, Alex also challenged the matter for a lack of probable cause.  The Court agreed with Alex DeMarco that there there was no proble cause for the criminal charges, and the matter was dismissed upon his motion, ultimatel making the medical evidence unecessary.
